Terms of Use
These Terms of Use ("Terms") govern your access to and use of the HealthPulse iOS application ("HealthPulse", the "App"). By downloading, installing, or using HealthPulse you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use HealthPulse. By using the App you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Not medical advice
HealthPulse is a wellness and fitness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Information shown by the App is for informational purposes only. Always consult a qualified healthcare professional regarding any medical condition, medication, or symptom. Never disregard professional medical advice or delay seeking it because of something you read in HealthPulse. In an emergency, call your local emergency services immediately.
3. Your account and Apple ID
HealthPulse relies on your Apple ID for in-app purchases and on iCloud for optional sync. You are responsible for maintaining the confidentiality of your Apple ID credentials and for all activity under them.
4. Subscriptions and in-app purchases
HealthPulse offers an optional Premium subscription with monthly and yearly options. Pricing, the length of any free trial, and renewal terms are shown inside the App at the time of purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription in your Apple ID settings under Subscriptions after purchase.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple and are subject to Apple's refund policies.
5. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use HealthPulse on Apple-branded devices that you own or control, for personal, non-commercial use. This license is also subject to the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement.
6. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by law.
- Use the App to violate any law or the rights of others.
- Interfere with or disrupt the App or its servers.
- Resell, rent, or sublicense the App.
- Use the App to provide medical advice, diagnosis, or treatment to others.
7. Your content
Health and wellness data you log in HealthPulse remains yours. We do not claim ownership over the data you create. You are responsible for the accuracy and lawfulness of any data you input.
8. Third-party services
HealthPulse integrates with Apple HealthKit, Apple iCloud (CloudKit), Apple StoreKit, and Firebase (Google) for crash and analytics. Use of these services is subject to their respective terms and privacy policies.
9. Intellectual property
The HealthPulse name, logo, app design, and software are owned by us and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our trademarks without prior written permission.
10. Disclaimers
HealthPulse is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the App will be uninterrupted or error-free. Health calculations and predictions are estimates and may be inaccurate.
11. Limitation of liability
To the maximum extent permitted by law, HealthPulse and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 50, whichever is greater.
12. Indemnification
You agree to indemnify and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or rights of a third party.
13. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may terminate by deleting the App from your device. Sections that by their nature should survive termination will survive.
14. Changes to the App and Terms
We may update or modify the App and these Terms from time to time. Material changes to the Terms will be reflected by updating the "Last updated" date at the top of this page. Continued use after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of your country of residence to the extent required by applicable law; otherwise, by the laws of the jurisdiction in which the App developer is established, without regard to its conflict-of-laws principles.
